Terms of Service

These terms govern your use of the Proctored One platform. By creating an account or otherwise using the platform you agree to these terms. If you are accepting on behalf of an organization, you represent that you have authority to bind that organization.
1. Service
Proctored One provides a candidate assessment and monitoring platform consisting of a control panel for operators, a desktop client for candidates, and supporting backend services. We grant you a non-exclusive, non-transferable license to access and use the platform for your internal hiring or assessment workflows during your subscription term.
2. Acceptable use
You agree not to:
- Use the platform to violate any applicable law or to discriminate unlawfully.
- Reverse engineer, decompile, or attempt to extract the source code of the platform except to the extent expressly permitted by law.
- Use the platform to monitor anyone without their informed consent and in compliance with the privacy laws of their jurisdiction.
- Submit content that infringes third-party rights or contains malicious code.
3. Customer data
You retain ownership of all data you and your candidates submit. We process customer data on your behalf as described in the Privacy Policy.
4. Payments
Paid plans are billed in advance on a recurring basis. Fees are non-refundable except as required by law. You authorize us to charge your designated payment method for renewals until you cancel.
5. Term and termination
Either party may terminate for material breach if the breach is not cured within 30 days of written notice. Upon termination, your license ends and we may delete customer data per our retention policy.
6. Disclaimers
The platform is provided “as is” without warranties beyond those required by law. Hiring decisions are yours alone; assessment results are inputs to your process and are not a recommendation.
7. Limitation of liability
To the maximum extent permitted by law, neither party is liable for indirect, incidental, special, or consequential damages. Direct liability is capped at fees paid by you in the 12 months preceding the claim.
8. Governing law
These terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law rules. Disputes shall be resolved in the state and federal courts of Delaware.
9. Changes
We may update these terms from time to time. Material changes will be announced via the control panel and email at least 30 days before they take effect.
